A final reminder that tavern and hotel on-licences must close at midnight on Thursday 24 December 2009, and may not sell or supply liquor on Christmas Day except to lodgers or patrons present on the premises for the purposes of dining, unless a special licence has been obtained. Off licence sales are also not permitted on Christmas Day.
In most areas it may now be too late to apply for a special licence because of the reporting timeframes. However, some members may still wish to discuss this with their District Licensing Agency and may yet be successful, but this should be done as soon as possible and in as much detail as possible about the “occasion or event” or “social gathering” for which a special licence is required.

It is important that members work carefully through staffing issues and look also at the economics of being open on the public holidays over Christmas and New Year. For some members the economics will suggest that they will be better off to remain closed. For others a surcharge may be necessary to preserve profitability.
HANZ has a resource designed to assist members with the complexities of the Holidays Act as it applies to the remuneration of employees on the Christmas and New Year public holidays. The resource includes a plain language explanation of public holiday entitlements and a flow chart. Finally, if applying a surcharge on any of the Christmas and New Year holidays to cover added costs of trading, the amount of the surcharge must be clearly displayed to patrons, for example on the menu or blackboard, prior to patrons ordering any food or beverages to which a surcharge applies.
